Smart Hawk Canada aims to provide its clients with high-quality investigation services. In return, clients are expected to pay the firm’s fees for professional services and for other charges and disbursements promptly upon receipt of accounts therefore, unless different arrangements are set forth in a service contract signed by the firm.

Fees:

Our base hourly fee or flat fee are based on the services requested and included in our service contract.

Other Charges and Disbursements:

Other charges and disbursements include any out-of-pocket expenses incurred for travel, hotel’s, retrieving the documents from online databases and other charges. We will advise you if the amount of the type of disbursements applicable to your investigation in our service contract.

Report Fees:

Our fee for preparing the final report is charged at our hourly base fee.

No Guarantee as to Outcome:

Although we will perform our professional services on your behalf to the best of our ability, we cannot and have not made any guarantees regarding the outcome of any services we perform. Any discussions we have with you about the outcome of any matter are our best professional estimates only and are limited by our knowledge at the time they are made.

Confidentiality, Verification and Reporting:

Please ensure you provide us with advance notice of specific instructions for ensuring confidentiality of information or documents delivered to you, or sent by fax, e-mail or other electronic means.

Collection, Use and Disclosure of Personal Information:

Your receipt of this Statement as contained in this letter, or by entering into a retainer agreement for investigation services, you hereby authorize and consent to the collection by Smart Hawk Canada of information that may include personal, credit or other information. You acknowledge and agree that such information may be used by Smart Hawk Canada for the purpose of providing investigation services and you consent to the disclosure of such information to appropriate third parties for such purposes. Smart Hawk Canada is authorized to retain the information for as long as may be required to complete the investigation services and for a reasonable period thereafter as may be required, or as may be required by law. You have the right to access applicable personal information collected by Smart Hawk Canada by contacting the Smart Hawk Canada Privacy Officer.

Termination:

You have the right to terminate our services at any time, on written notice to us. In such case a final account for the fees, charges, disbursements, and applicable taxes incurred if applicable will be rendered, which we expect will be promptly paid. We have the right to terminate our services if we are not paid within thirty (30) days of the date of an account, or for any reason we feel is reasonable to terminate our services.

Jurisdiction:

This agreement for the provision investigation service and related retainer is governed by and construed under the laws of the Province of Ontario to the exclusion of all other laws of any other jurisdiction, province, state, or country.

Prior to starting the investigation, we will invoice you for our required retainer and the amount will be applied to our fees.
